Stellatris Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the Stellatris web application, mobile application, or platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Stellar Trace, LLC ("Stellatris", "we", "us", or "our"). If you do not agree to these Terms, you may not access or use the Service.

2. CRITICAL MEDICAL DISCLAIMER – PLEASE READ CAREFULLY

STELLATRIS IS A TECHNOLOGY PLATFORM, NOT A HEALTHCARE PROVIDER.

No Medical Advice: The Service, including all text, data, "Health Passport" features, and "Network Safety Alerts," is for informational purposes only and does not constitute medical advice, diagnosis, or treatment.
No Doctor-Patient Relationship: Your use of the Service does not create a physician-patient or clinical relationship.
Emergency Situations: IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR EMERGENCY SERVICES IMMEDIATELY. Do not rely on the Service for urgent medical needs.
Accuracy of Data: Stellatris facilitates the sharing of information but relies on user self-reporting data. We do not guarantee the accuracy, completeness, or clinical validity of any health status displayed.

3. Description of Services & Subscription Tiers

Stellatris provides specialized tools for STI health management and network safety. Features are determined by your selected tier:

Stellatris Stardust: Personal health logging, sharing of STI statuses with connected users on platform, unlimited incoming connections, a single outgoing connection, and 1st-Degree Safety Alerts (notifications involving direct connections).
Stellatris Nebula: Includes all Stardust features plus additional allotment of outgoing connections.
Stellatris Protostar: Includes all Nebula features plus 2nd-Degree Safety Alerts (notifications involving connections-of-connections) and the highest allotment of outgoing connections.

4. Account Security and Device Integrity

Due to the sensitive nature of health data, you are responsible for maintaining the confidentiality of your credentials.

Security Measures: You agree to maintain appropriate security on the personal devices used to access the Service (e.g., passcodes, biometric locks, multifactor authentication).
Liability: Stellatris is not liable for any data exposure resulting from your failure to secure your personal hardware or account credentials.

5. User Conduct: The "Good Neighbor" Policy

To protect the integrity of our community, you agree to the following:

Anti-Harassment: You are strictly prohibited from using connection or notification features to harass, stalk, or intimidate any member.
Honesty & Good Faith: You agree to use the Service only for legitimate health management. Knowingly entering false positive results or triggering false exposure alerts is a material breach of these Terms and may result in immediate account termination.
Anonymity Acknowledgment: While we take technical measures to mask identities in safety alerts, you acknowledge that recipients may deduce the source of an alert based on their own social context.

6. Network Safety Alerts (Closed-Loop System)

Stellatris operates a closed network for the safety of its members.

Mutual Consent: Safety alerts are only sent to individuals who are active members of Stellatris and have established a confirmed "Connection" with you.
Authorization: By establishing a connection and sharing your status, you provide explicit authorization for Stellatris to notify your connections of potential exposure events.
Delta Notifications and Cooldown Windows: To prevent notification fatigue, Stellatris employs logic that may filter repeat positive alerts within a period of time, known as the cooldown window. The notification cooldown window is aligned with the specific treatment window for the STI reported by the user (i.e., the time it takes for follow-up STI test for cure to be ordered by a healthcare provider after treatment), as defined by the U.S. Government’s Centers for Disease Control and Prevention (CDC) STI Treatment Guidelines. For infections where the CDC does not specify a standard test of cure timeframe, the cooldown window will default to a standard system timeframe of 30 days post treatment. Only newly connected partners to the positive partner during the specific STI treatment window will be notified of that positive test tied to the same infection. Once the standard STI treatment window from the initial infection has passed, the cooldown notification window will be lifted and all directly connected partners will be notified for new positive STI test results.
No Third-Party Notifications: Stellatris does not send notifications to non-members. You are responsible for notifying non-member partners through external means.

7. Payment, Renewals, and Third-Party Processors

Payment Processing: We use a secure third-party payment processor to handle billing and subscription fees. By making a purchase, you agree to the terms of our third-party payment provider.
Information Storage: Stellatris does not directly store your full credit card or bank account information on our servers; this data is maintained by our payment processor.
Billing: Fees are billed in advance and are non-refundable unless required by law. If you cancel your subscription during a billing period, you will retain access to your tier's features until the end of that billing period, provided your Stellatris account remains active. However, if you delete your Stellatris account, your subscription will be terminated immediately. You will immediately lose access to all Stellatris services and features, and no refunds or credits will be issued for any remaining time in your billing cycle.

8. Third-Party Infrastructure and Cloud Hosting

You acknowledge that the Service is hosted on third-party cloud infrastructure. Stellatris uses reasonable efforts to select secure providers but has no direct control over the availability or independent security of these external servers.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STELLATRIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING THE ACCURACY OF HEALTH LOGS, THE DELIVERY OR INTENTIONAL DELAY OF SAFETY ALERTS DUE TO THE DELTA NOTIFICATION COOLDOWN WINDOWS, OR ANY OUTAGES CAUSED BY THIRD PARTY CLOUD OR PAYMENT PROVIDERS.

10. DISPUTE RESOLUTION: ARBITRATION & CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution: Before filing any formal claim, you and Stellatris agree to try to resolve the dispute informally by emailing contact@stellatris.com, with a detailed description of the dispute. We will have 90 days to attempt a good-faith resolution.
Small Claims Court: If the dispute is not resolved within 90 days, either party may bring an individual action in small claims court.
Binding Arbitration: For all other disputes, you and Stellatris agree to resolve the matter through binding individual arbitration administered by the American Arbitration Association (AAA).
CLASS ACTION WAIVER: YOU AGREE THAT ANY CLAIMS WILL BE BROUGHT ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.
